Brickture Terms of Service

TAKGIO INC. · Effective September 17, 2026 · Last updated September 17, 2026

Two things worth reading first.

1. Who we are and what these terms cover

Brickture ("Brickture," the "App," or the "Service") is provided by TAKGIO INC., a New Jersey corporation ("TAKGIO," "we," "us," or "our"). These Terms of Service (the "Terms") are a binding agreement between you and TAKGIO governing your access to and use of the App and any related services, websites, and content.

By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy, which are incorporated by reference. If you do not agree, do not use the App.

2. What Brickture does

Brickture lets you take or select a photo of a real-world object and generates a brick-style 3D model of that object, along with step-by-step building instructions and a suggested parts list. The Service runs partly on your device and partly on our cloud servers and third-party services (see Section 9).

Brickture produces a digital design and instructions. It does not sell, supply, or ship physical bricks or building sets, and it is not affiliated with any brick manufacturer (see Section 11).

3. Eligibility and age

The App is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

4. Your access and licence to the App

Using the App requires an account. You sign in with an email address, or with Sign in with Apple or Google; there is no password. You are responsible for keeping access to the mailbox or provider account you sign in with. You may delete your account at any time from the Account screen in the App. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, for your own personal, non-commercial use, subject to these Terms and to the app store terms you accepted (Apple App Store / Google Play). All rights not expressly granted are reserved.

5. The photos you submit (your "Input")

The photo you submit becomes the property of TAKGIO. When you submit a photo to the App (your "Input"), you assign to TAKGIO all right, title and interest in the copy of that image held by the Service, so that we may host, copy, transmit, process and analyse it and create the resulting model and instructions.

This does not affect the original photograph on your own device, which remains yours, and it does not give TAKGIO any rights in the object, person, artwork or property that the photograph depicts.

Limits we accept on Inputs. We use Inputs to operate and improve the Service. We do not sell Inputs, licence them to third parties for those third parties' own purposes, or use them for advertising. We process Inputs as described in the Privacy Policy — including transmitting a cleaned, metadata-stripped copy to our 3D-generation provider — and we will delete an Input on request.

You represent and warrant that, for every Input you submit, you own it or have all rights and permissions necessary to submit it and to make the assignment above; and that the Input does not infringe or violate any third party's intellectual property, privacy, publicity, or other rights, and does not violate the Acceptable Use Policy or any law.

6. What the App generates (the "Output")

TAKGIO owns the brick-style model, the step-by-step instructions and the parts list that the Service generates (the "Output"), and all intellectual property in them.

Provided you comply with these Terms, TAKGIO grants you a personal, non-exclusive, non-transferable, revocable licence to view, build from, replay, download and share your Output for your own personal, non-commercial purposes.

You are responsible for how you use Output. Because Output is derived from your Input, if your Input depicts something protected by a third party's rights (for example, a copyrighted sculpture, character, or branded product), your Output may be subject to those rights, and it is your responsibility to have permission for any use beyond personal, private building.

7. Acceptable use

Your use of the App is subject to our Acceptable Use Policy, which prohibits, among other things, submitting content you do not have rights to, unlawful or infringing content, pornographic content, and misuse of the Service. Violation may result in suspension or termination of your access.

You may not resell the App or the Service, or use either for profit, unless a written agreement is made with TAKGIO.

8. Purchases, credits, and refunds

The App may offer paid features, including a limited number of photo conversions or "credits" available for purchase. The full terms are in the Purchase, Credits and Refunds Policy, which forms part of these Terms.

Billing is handled by the app stores. All purchases are processed by Apple or Google through their in-app purchase systems and are subject to their terms. We do not receive or store your payment card details.

Digital nature; no refunds. Credits and conversions are digital items delivered immediately. Except where required by law or by the app store's own policies, purchases are non-refundable once the associated conversion has been used. Refund requests are handled under Apple's or Google's applicable policies.

Changes to pricing and offerings. We may add, change, or discontinue paid features, pricing, and credit allowances at any time. During the current beta, some features may be provided free or with usage limits and may change without notice.

9. Third-party services

The Service relies on third parties, including Tripo (operated by VAST — 3D-mesh generation, which receives a cleaned, metadata-stripped copy of your photo), Fly.io (cloud hosting and storage), RevenueCat (purchase validation, once paid credits are live), and Apple / Google (app distribution and billing). Your use of those services through the App is also subject to their terms and privacy practices. We are not responsible for third-party services, and their availability may affect the Service.

10. Our intellectual property

The App, its software, pipeline, design, the "Brickture" name and logo, and all related content (including Output) are owned by TAKGIO or its licensors and are protected by intellectual-property laws. Except for the limited licences granted in Sections 4 and 6, these Terms grant you no rights, implied or otherwise, in TAKGIO's intellectual property. You may not copy, modify, reverse engineer, decompile, resell, or create derivative works of the App, except to the extent that restriction is prohibited by law or by the app store's terms.

11. Trademark and no affiliation

Brickture and TAKGIO are independent and are not affiliated with, sponsored by, or endorsed by the LEGO Group or any other brick or toy manufacturer. "LEGO" is a trademark of the LEGO Group, which does not sponsor, authorise, or endorse this App. All other product and company names and marks are the property of their respective owners. References to bricks or brick-building describe a style of model and general compatibility only.

12. Copyright complaints

If you believe material processed or made available through the App infringes a copyright you own or control, contact us at support@takgio.com and see our Copyright & DMCA Policy for how to submit a notice and a counter-notice.

13. Disclaimers

THE APP AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, that any generated model or parts list will be accurate, complete, buildable, physically stable, or suitable for any purpose, or that any suggested part is available for purchase.

Building with small parts can pose choking and other hazards. You are solely responsible for safe building and adult supervision where appropriate. No one under the age of 8 may use this App.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKGIO AND ITS OWNERS, CONTRACTORS, AND SUPPLIERS, INCLUDING BUT NOT LIMITED TO APPLE AND GOOGLE, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify, defend and hold harmless TAKGIO, Apple and Google, and their respective owners, officers, contractors and subcontractors, from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees and costs) arising from your Inputs, your Output, your use of the App, or your violation of these Terms or any law or third-party right.

16. Governing law, arbitration, and class-action waiver

Governing law. These Terms and any dispute arising out of or relating to them or to the App are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules.

Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms or the App will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction. The arbitration will be conducted by a single arbitrator. Unless the parties agree otherwise, any in-person hearing will take place in Bergen County, New Jersey, and the arbitrator may permit appearance by telephone or video.

Class-action waiver. The parties waive any right to bring or participate in any claim on a class, collective, consolidated or representative basis. The arbitrator may award relief only in favour of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. If this class-action waiver is found unenforceable as to a particular claim, that claim — and only that claim — will be severed from arbitration and heard in the courts identified below; the remainder of this Section stays in force.

Waiver of court and jury trial. Except as stated in this Section, the parties waive any right to file in civil court and any right to a trial by judge or jury, so that disputes proceed in arbitration before the AAA to final and binding resolution.

Small-claims exception. Either party may bring an individual claim in a small-claims court of competent jurisdiction if the claim qualifies and remains in that court.

Your right to opt out. You may opt out of this arbitration and class-action waiver Section by sending written notice to support@takgio.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out affects nothing else in these Terms.

Courts. For any claim not subject to arbitration, and for any action to enforce an arbitration award, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Bergen County, New Jersey.

Territory. The App is controlled and operated from the United States; we make no representation that it is appropriate or available elsewhere.

17. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or to protect the Service or others. You may stop using the App at any time. Sections that by their nature should survive termination (including Sections 5, 6, 10, 13–16 and 18) will survive.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide notice in the App. Your continued use after changes take effect means you accept the updated Terms.

19. Third-party beneficiaries

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. Google is a third-party beneficiary of these Terms to the extent required by the Google Play Developer Distribution Agreement.

20. Miscellaneous

These Terms, together with the Privacy Policy, the Acceptable Use Policy, the Purchase, Credits and Refunds Policy and the Copyright & DMCA Policy, are the entire agreement between you and TAKGIO regarding the App. Your relationship with Apple and with Google is governed by their own separate agreements with you, which these Terms do not replace. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor or affiliate.
